Estate and Wills

The Probate Court has original and exclusive jurisdiction over the probate of Wills of decedents domiciled in Fulton County.

Any person who has in his possession the Will of a decedent is required to file it with the Judge of the Probate Court of the county having jurisdiction.

Any person desiring to prepare a Will is advised to consult with an attorney.

The Probate Court also has exclusive jurisdiction over the estate of decedents who die without a Will. In the absence of a Will, an Administrator may be appointed to handle the affairs of the estate. There may be other methods for handling the estates of persons who die without Wills. You may wish to consult with an attorney to explore these options.
